Terms and Conditions for Rubbish Removal Battersea

These Terms and Conditions set out the basis on which Rubbish Removal Battersea provides waste collection and related services. By making a booking, accepting a quotation, or allowing our operatives to commence work, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings given below:

1.1 Client means any individual, company or organisation requesting or receiving our rubbish removal or associated services.

1.2 Services means waste collection, rubbish removal, clearance, loading, transportation, recycling and disposal services provided by us, together with any additional services agreed in writing.

1.3 Waste means any items, materials, junk, refuse, debris or goods which the Client instructs us to remove, whether household, commercial or construction related, excluding any prohibited or hazardous materials that we are not authorised to handle.

1.4 Order means a booking or confirmed request for Services made by the Client via telephone, email, online form or in person and accepted by us.

1.5 Quotation means a price or estimate provided by us for the performance of the Services, whether given verbally or in writing.

2. Scope of Services

2.1 We provide rubbish removal and waste collection services in Battersea and surrounding areas, including the loading, transportation and lawful disposal or recycling of Waste collected from the Client’s premises or other agreed location.

2.2 The precise nature and scope of the Services shall be as described in the Quotation and confirmed in the Order. Any additional services requested on site that fall outside the original Quotation may incur additional charges.

2.3 We reserve the right to decline, vary or cancel any Order where, in our reasonable opinion, it would be unsafe, unlawful, impractical, uneconomical or otherwise inappropriate to carry out the Services as requested.

3. Booking Process

3.1 Clients may request a Quotation and book Services by telephone, email or online. To provide an accurate Quotation, we may request descriptions, photographs, approximate weights, volumes, access details and other relevant information about the Waste and the location.

3.2 Any Quotation given without a site visit is an estimate only and may be subject to change when our operatives arrive and assess the actual volume, type and accessibility of the Waste.

3.3 A booking is not confirmed until we have accepted the Client’s Order and provided a booking reference, appointment time or written confirmation. We reserve the right to refuse any booking at our discretion.

3.4 The Client is responsible for ensuring that all information provided at the time of booking is accurate and complete. Any inaccuracies may result in additional charges, delays, or cancellation of the Services.

4. Access and Client Obligations

4.1 The Client must ensure that our operatives have safe, adequate and uninterrupted access to the collection point at the agreed time. This includes arranging any necessary parking permissions, entry codes, security clearances or building access.

4.2 The Client must be present at the property during the collection window unless otherwise agreed in advance. Where the Client is not present, we may, at our discretion, proceed with the collection based on prior instructions, or treat the Order as cancelled and apply the relevant charges.

4.3 The Client must ensure that the Waste to be removed is clearly identified, separated from items not intended for removal, and accessible without unreasonable dismantling, moving of obstacles, or risk to health and safety.

4.4 We will not be responsible for removing items that are not clearly designated as Waste, and we accept no liability for any alleged removal of items where it was reasonable for our operatives to treat them as Waste based on the Client’s instructions and the circumstances on site.

5. Waste Types and Prohibited Materials

5.1 We provide rubbish removal for a wide range of non-hazardous household, garden, commercial and light construction Waste. All collections are subject to compliance with applicable waste management laws and regulations.

5.2 We do not ordinarily collect hazardous or prohibited materials such as asbestos, clinical or medical waste, liquids, chemicals, solvents, oils, gas bottles, pressurised containers, explosives, radioactive materials, or any other substance we are not licensed or equipped to handle.

5.3 If prohibited or hazardous materials are discovered among the Waste at the time of collection, we may refuse to remove them, adjust the Quotation, or cancel the Services in whole or in part. The Client may be charged a call-out or cancellation fee in such circumstances.

5.4 The Client warrants that all Waste presented for collection is safe, lawful and suitable for removal, and that the Client has the right to dispose of such items. The Client shall be responsible for any loss, damage, fine or claim arising from any breach of this warranty.

6. Pricing and Quotations

6.1 Prices for our Services are generally based on the volume, weight, type of Waste, labour required, and distance from the vehicle, together with any applicable disposal or recycling charges.

6.2 Unless stated otherwise, all prices are quoted in pounds sterling and may be stated exclusive or inclusive of VAT. The Client will be informed where VAT applies.

6.3 Any Quotation is given in good faith based on the information provided by the Client and does not constitute a binding offer. We reserve the right to revise the price if the actual Waste, access or circumstances differ from those described at the time of booking.

6.4 If the revised price is not acceptable to the Client, the Client may cancel the Services, but a reasonable call-out charge or cancellation fee may be applied to cover our costs.

7. Payments and Invoicing

7.1 Payment is due on completion of the Services on the day of collection, unless otherwise agreed in writing in advance. We may require payment in full or a deposit prior to commencing work.

7.2 We accept common payment methods including cash, major debit or credit cards, and bank transfer where agreed. We do not accept payment by cheque unless expressly confirmed.

7.3 For business Clients with credit terms, invoices must be paid within the agreed period. If no period is specified, payment is due within 14 days of the invoice date.

7.4 We reserve the right to charge interest on overdue amounts at the statutory rate applicable to commercial debts, together with any reasonable costs incurred in recovering the debt.

7.5 Title to any collected Waste passes to us only upon full payment for the Services. Until payment is received, we are entitled to recover or retain the Waste or to seek recovery of our charges by other lawful means.

8. Cancellations and Amendments

8.1 The Client may cancel or amend a booking by giving us notice by telephone or email. Any cancellation or amendment is only effective when acknowledged by us.

8.2 If the Client cancels less than 24 hours before the scheduled collection time, we reserve the right to charge a late cancellation fee, which may be up to the full quoted amount where we have incurred costs or allocated resources that cannot be redeployed.

8.3 If our operatives attend the location at the agreed time and are unable to gain access, or the Waste is not available as described, we may treat this as a cancellation by the Client and apply a call-out or cancellation charge.

8.4 We may cancel or reschedule a booking at any time for operational, safety, legal or other reasonable reasons, including traffic disruption, vehicle breakdown, staff illness, severe weather or site conditions. In such cases, we will aim to provide as much notice as reasonably practicable and to offer an alternative appointment. We shall not be liable for any loss arising from such cancellation or rescheduling, save for refunding any pre-paid amounts for Services not performed.

9. Performance and Time

9.1 Any arrival times, collection windows or completion dates provided are estimates only and are not guaranteed. While we make reasonable efforts to attend on time, we shall not be liable for delays caused by events beyond our reasonable control.

9.2 The Client should allow sufficient time between the scheduled Services and any related work, such as building contractors, property viewings or tenancy changes, as we cannot accept responsibility for consequential losses arising from delays.

10. Damage and Liability

10.1 We will exercise reasonable care and skill in performing the Services. However, clearance and rubbish removal work can involve moving bulky, awkward or heavy items in confined spaces, which can carry an inherent risk of minor damage.

10.2 The Client is responsible for protecting any vulnerable surfaces, fixtures, fittings or belongings prior to the commencement of the Services. This includes, where appropriate, covering floors and walls, moving fragile items, and securing valuables.

10.3 Our total liability for any direct loss or damage arising from our negligence or breach of contract shall be limited to the lesser of the cost of repair or replacement of the damaged property, or the total price paid or payable for the Services under the relevant Order.

10.4 We shall not be liable for any indirect or consequential loss, including loss of profit, loss of opportunity, loss of use, or any costs incurred due to delays or cancellations.

10.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, or any other liability which cannot lawfully be excluded or limited.

11. Waste Transfer and Environmental Compliance

11.1 We operate in accordance with applicable waste management and environmental legislation in the United Kingdom. All collected Waste is taken to authorised facilities for reuse, recycling, recovery or disposal.

11.2 Where required by law, a waste transfer note or similar documentation will be completed to record the transfer of control of the Waste from the Client to us. By accepting the Services, the Client consents to the completion and retention of such documentation.

11.3 We endeavour to minimise the environmental impact of our operations by maximising reuse and recycling where feasible. However, we do not guarantee that any particular item will be recycled or reused unless explicitly agreed in writing.

12. Client Indemnity

12.1 The Client shall indemnify and keep us indemnified against any claims, losses, damages, costs, expenses or liabilities arising from:

a) any breach by the Client of these Terms and Conditions;

b) any inaccuracy in the information provided by the Client at the time of booking or during the provision of the Services;

c) the presence of hazardous, prohibited or unlawful materials among the Waste;

d) any claim by a third party alleging that the Waste did not lawfully belong to the Client or that the Client did not have the right to dispose of it.

13. Complaints and Disputes

13.1 If the Client is dissatisfied with any aspect of the Services, the Client should contact us as soon as possible, providing details of the issue and any supporting evidence such as photographs.

13.2 We will investigate complaints in good faith and, where appropriate, may offer to rectify any issues, provide a partial refund, or take other reasonable steps to resolve the matter. Any remedy offered shall be at our discretion, subject to applicable law.

13.3 Any disputes arising under or in connection with these Terms and Conditions should first be raised directly with us to seek an amicable resolution.

14. Data Protection and Privacy

14.1 We may collect and process personal information about the Client, such as contact details, service addresses and payment information, for the purposes of booking, delivering and administering the Services.

14.2 We will use such information in accordance with applicable data protection legislation and only for legitimate business purposes, including handling enquiries, managing bookings, processing payments, and addressing complaints or claims.

14.3 The Client is responsible for ensuring that any personal data provided to us relating to other individuals is provided lawfully and with appropriate consent where required.

15. Variations to Terms

15.1 We reserve the right to amend or update these Terms and Conditions from time to time. The version in force at the time of the Client’s Order shall apply to that Order and the related Services.

15.2 Any variation to these Terms and Conditions requested by the Client shall only be effective if agreed in writing by an authorised representative of Rubbish Removal Battersea.

16. Severability

16.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall, to the extent required, be deemed deleted, and the remaining provisions shall continue in full force and effect.

17. Governing Law and Jurisdiction

17.1 These Terms and Conditions and any contract between the Client and Rubbish Removal Battersea for the provision of rubbish removal or waste collection services shall be governed by and construed in accordance with the laws of England and Wales.

17.2 Any dispute, claim or matter arising out of or in connection with these Terms and Conditions or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales, to which both parties irrevocably submit.

By placing an Order or allowing our operatives to commence work, the Client confirms that they have read, understood and agree to be bound by these Terms and Conditions for all rubbish removal and waste collection services provided by Rubbish Removal Battersea.
